1. Agreement to Terms

By accessing or using masses.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and anyone who accesses or uses the Service.

2. Description of Service

masses.ai is an AI products and marketplace platform that enables users to discover, purchase, and deploy AI templates, scripts, and tools. We also provide educational content and a newsletter.

3. Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, complete, and current information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to terminate accounts, refuse service, or remove content at our sole discretion.

4. Purchases and Payment

All purchases are subject to our Refund Policy. By making a purchase, you authorize us to charge your payment method for the stated amount. Prices are subject to change without notice. We use Stripe to process payments securely. We do not store your full payment card information.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of masses.ai and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Sellers on the marketplace retain ownership of their original content. By listing on masses.ai, sellers grant us a non-exclusive, worldwide, royalty-free license to display, promote, and distribute their listed products within the Service.

6. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload or transmit malicious code, viruses, or harmful software
• Attempt to gain unauthorized access to any part of the Service
• Harass, abuse, or harm other users
• Engage in fraudulent activity, including misrepresenting products
• Scrape, crawl, or index any part of the Service without our express written consent
• Use the Service to send unsolicited communications (spam)

7. Marketplace Listings

Sellers are solely responsible for the accuracy and legality of their listings. masses.ai does not endorse or guarantee any product listed on the marketplace. We reserve the right to remove any listing that violates these Terms or that we determine, at our sole discretion, is inappropriate.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MASSES.AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless masses.ai and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, as mutually agreed.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
